අපරාධ පරීක්ෂණ දෙපාර්තමේන්තුවේ හිටපු අධ්‍යක්ෂ ශානි අබේසේකර විසින් ඉදිරිපත් කළ මූලික අයිතිවාසිකම් පෙත්සම ඔක්තෝබර් මස 16 වනදා කැඳවන ලෙස ශ්‍රේෂ්ඨාධිකරණය අද (20) දින නියම කර ඇති බව වාර්තා වේ.
පාස්කු ඉරුදින ත්‍රස්ත ප්‍රහාර සිද්ධිය වළක්වාගැනීමට කටයුතු නොකිරීම සම්බන්ධයෙන් සිදුකරන විමර්ශනයකට අදාළව අපරාධ පරීක්ෂණ දෙපාර්තමේන්තුව විසින් තමන්ව අත්අඩංගුවට ගැනීම වැළැක්වීමේ නියෝගයක් නිකුත් කරන ලෙස ඉල්ලා මෙම පෙත්සම ගොනුකර තිබුණි.
මෙම පෙත්සම ජනක් ද සිල්වා, ප්‍රියන්ත ප්‍රනාන්දු සහ සම්පත් අබේකෝන් යන ශ්‍රේෂ්ඨාධිකරණ විනිසුරු මඩුල්ල ඉදිරියේ කැඳවනු ලැබූ අතර එහිදී විනිසුරු මඩුල්ල නියම කළේ, එම පෙත්සම කරුණු තහවුරු කිරීම සඳහා ඔක්තෝම්බර් මස 16 වනද කැඳවන ලෙසයි.
පෙත්සම්කරු කියා සිටින්නේ ඉකුත් රජය සමයේ පාස්කු ඉරුදින ත්‍රස්ත ප්‍රහාරය වළක්වාගැනීමට කටයුතු නොකිරීම සම්බන්ධයෙන් අපරාධ පරීක්ෂණ දෙපාර්තමේන්තුව විසින් කුලියාපිටිය මහේස්ත්‍රාත් අධිකරණයට කරුණු වාර්තා කළ බවයි.
පාස්කු ඉරුදින ත්‍රස්ත ප්‍රහාරය එල්ල කළ සහරාන් හෂිම් සම්බන්ධයෙන් නිසියාකාරව විමර්ශන සිදු නොකළ බව සඳහන් කරමින් අපරාධ පරීක්ෂණ දෙපාර්තමේන්තුව විසින් කුලියාපිටිය මහේස්ත්‍රාත් අධිකරණය හමුවේ කරුණු වාර්තා කෙරුණු බවත් පෙත්සමේ සඳහන් කර ඇත.
ඊට අදාළව තමන්ව අත්අඩංගුවට ගැනීමේ සූදානමක් පවතින බව පෙන්වාදුන් පෙත්සම්කරු, කිසිදු සාධාරණ හේතුවක් නොමැතිව ද්වේශසහගත ලෙස තමන්ව අපරාධ පරීක්ෂණ දෙපාර්තමේන්තුව විසින් අත්අඩංගුවට ගැනීම වළක්වාලන නියෝගයක් නිකුත් කරන ලෙස ඉල්ලා මෙම පෙත්සම ගොනු කර තිබුණි.
It is reported that the Supreme Court today (20) has fixed the fundamental rights petition filed by Shani Abeysekera, the former director of the Criminal Investigation Department, on October 16.
The petition was filed by the Criminal Investigation Department seeking an order to prevent his arrest in connection with an investigation into the failure to prevent the Easter Sunday terror attack.
The petition was taken up before the Supreme Court bench of Justices Janak de Silva, Priyantha Fernando and Sampath Abeykoon, where the bench directed that the petition be heard on October 16 for verification of facts.
The petitioner claims that the Criminal Investigation Department reported the matter to the Kuliapitiya Magistrate Court regarding the failure of the previous government to prevent the Easter Sunday terror attack.
The petition also stated that the Criminal Investigation Department reported the facts before the Kuliapitiya Magistrate’s Court stating that Saharan Hashim, who carried out the Easter Sunday terror attack, was not properly investigated.
The petitioner, who pointed out that preparations are underway to arrest him, had filed this petition seeking an order restraining him from being arrested maliciously by the Criminal Investigation Department without any reasonable cause.
